Sentenced to three years' imprisonment an educator at a juvenile centre for assaulting a girl under guardianship in Gipuzkoa
The accused has acknowledged the facts and the charges have agreed to reduce his request for a sentence from eleven to three years.
An educator at a juvenile residence has been sentenced to three years' imprisonment for sexually assaulting an unprotected girl who is under the guardianship of the Provincial Council of Gipuzkoa between 2019 and 2022, when the girl was between 13 and 14 years old.
Initially, the Public Prosecutor's Office requested eleven years' imprisonment for this man, but on Monday, shortly before the start of the trial in the First Section of the Gipuzkoa High Court, the defence, the private prosecution, the victim, and the prosecution reached an agreement of conformity.
Under this agreement, the accused has acknowledged the facts and the charges have agreed to lower his request for punishment after modifying the provisional conclusions and applying the mitigating of undue extensions.
Thus, the victim, who is now of age, has not been obliged to make a statement at the oral hearing.
In addition to the above-mentioned prison sentence, the accused shall compensate the injured party with €16,000 for the moral damage suffered and shall not be able to approach or communicate with him for twelve years, and shall also be on probation for seven years after his release.
He is also sentenced to five years' disqualification for any activity or profession related to minors for a period of five years.
The prosecution's indictment states that the incident took place at the above-mentioned protection centre in Aia, where the defendant, "acting with playful intent", abused the child "using the condition of superiority conferred upon him by the position of educator".
In this way, the man took advantage of his good relationship with the girl to ask her to take pictures of her intimate parts in exchange for leaving her cell phone to give her more food or money.
The defendant even touched her several times.
The report of the Public Prosecutor's Office further specifies that, at some point, the man helped the minor escape from the facility, and twice more went to sleep at the educator's house in separate beds while he was on the run.
