Lawyers for defendants in the Kitchen case have called for the trial to be suspended on the grounds that there have been errors in the injunction
At the first session, on previous issues, the lawyers of the ten defendants have asked to suspend the trial against the head of the Ministry of the Interior at the time of the Government of Mariano Rajoy.
Thedefenses of the defendants in the Kitchen case, including the lawyer of former Spanish Minister of theInterior Jorge Fernández Díaz , have requested the suspension of the trial being held in the National High Court on the grounds that there were errors in the investigation and that the court is not competent to try the case.
At the first session, on previous issues, the lawyers of the ten defendants have asked to suspend the trial against the head of the Ministry of the Interior at the time of the Government of Mariano Rajoy.
Around the party and PP leaders, the former treasurer of thepeople, Luis Bárcenas, the ten defendants were prosecuted for attempting to steal classified information.
The lawyer for the former Minister of the Interior, Jorge Fernández Díaz, has been the first to request the suspension of the trial on the grounds that the National High Court is not competent to prosecute the case because "these are factsthathave nothing to do with the Tandem or Villarejo case ".
Further arguments have been used to justify the request. Specifically, they argue that the secrecy of the proceedings lasted for almost the entire investigation (2 years and 7 months), thereby violating their right of defence, as the defendants claim, by secretly gathering evidence.
Counselhas also cited among the reasons for the "accidental allegations" , "because several of the offences prosecuted were first reported in the indictment, rather than mentioned during the injunction.
They have therefore also requested the cancellation of some of the evidence.
Villarejo reported that this is a prospective investigation.
The lawyer for the former Commissioner Villarejo, on the other hand, has denounced the investigation as "prospective" and "illegal", considering that it has violated the rights of privacy and defence of the police — the owner of the confiscated files — all of which, in his words, have not been decrypted, so that they have not been able to collect all the material or verify the evidence received.
