ELA must be compensated by Tubos Reunion Threads for a serious violation of the right to strike
The Labour Inspectorate found that the company had replaced the workers on strike with other workers on the staff and the TSJPV has confirmed this conclusion.
The High Court of Justice of the Basque Country (TSJPV) has upheld the decision of the Social Court of Vitoria-Gasteiz and has sentenced the company Tubos Reunidos Premium Threads to compensate the ELA unionwith 50,000 euros for "serious violation" of the fundamental right to strike.
According to ELA in a statement, the Álava Labour Inspectorate found that the company based in Nanclares de la Oca carried out "internal skirolaj practices" during the strike between July and September 2024, and the judgement confirms this conclusion.
The union has explained that the workers who were on strike "were replaced with other staff\u00A0 with the aim of maintaining productive activity ". They have added that this is a" very serious violation "of a fundamental right.
The workers of Tubos Reunidos Premium Threads carried out an indefinite eight-week strike in the summer of 2024 with the aim of negotiating their own agreement for the 73 workers of this multinational.
ELA has stressed that the ruling "strengthens the protection of the right to strike" and makes it clear that companies "cannot neutralize a strike through covert substitutions or activities aimed at emptying it of content".
