In the fall of 2025 there was an 83 day strike when workers changed their locker room to report that the change involved an extension of the working day of 15-30 minutes. The courts proved them right.
Petronor's management has held a meeting with the Works Council onMondayat which it informs them that has the maintenance of the former locker rooms of the Muskiz factory , in compliance with the ruling of the High Court of Justice of the Basque Country Justicia (although it has also stated that it intends to appeal) and has also transferred to them a new formofchange of shift between the staff.
In September, the old locker rooms were closed and moved to the new ones at the entrance to the building, and an indefinite strike began, alleging that the company was extending its working day and that they had been subjected to a Substantial Change in Working Conditions. The trial took place on 27 November and in a recent judgment, the judge declared "unjustified" and suspended the change of locker rooms proposed by the company.
Of course, the old locker rooms need to be adjusted to again, and they will need a deadline to do so too, the management said.
It has also proposed a "new procedure for staff shifts" to ensure safety conditions at all times, which has raised the suspicions of the CC.OO. union.
CC.O. 's doubts.
The CC.OO. calls for the shift change system announced today by themanagement not to be implemented because it has asked the judge for explanations of its ruling . In particular, it wants to determine whether the change of clothes to be made by the worker before leaving the street should be included in the working day, as requested by the unions, or outside the working day, as proposed by the new system.
The union has explained that the ruling suggests that "relapses should be made as they were done before, within the working day", although it does not specify it verbatim, and "since it has not been specified, the company intends to use the relay to leave the working day and interprets it to be outside", the union has added.
CC.O. has pointed out that in itself "there is no conflict" with the location of the locker room, which is used by almost half of the staff, "the influence and all the conflict comes from the shift days." "The conflict is not about the locker room, but about the change of clothes at the end of the day and the determination whether the cleaning is inside or outside the working day."
The union has complained that the company used the change in the location of the locker room to "get out of the workday", so "we have asked the judge for an explanation, to know the judge's opinion, to say whether that should be inside or outside the workday," a representative said.
