The High Court of Justice of Navarre has upheld the prison sentence for continuing sexual assault and will compensate the victim with €60,000 for moral damage.
The Navarre High Court of Justice has upheld the 14-year prison sentence imposed in March by the First Section of the Provincial High Court on a man who repeatedly raped his stepdaughter,who was then 23years old.
According to the judgement, which may be appealed to the Supreme Court, the High Court of Justice of Navarre has upheld the sentence of imprisonment for a continuing offence of sexual assault and will compensate the victim with €60,000 for moral damage.
The defendant may not approach less than 300 metresor communicate with the complainant for 20 years and must comply with a probation measure to be served after a prison sentence of 8 years.
In March 2013, the victim, who was then 23 years old, arrived in Spain with her 9-month-old son for treatment, and was housed in the home of the complainant's mother and her husband in the Pamplona region.
As a result of continued sexual assault (reported 9 years later), the victim "suffers psychological damage or consequences and continues to suffer from depressive symptomatology, such as sadness, shame, a tendency towards isolation and guilt, which results mostly from what has happened, even though other episodes, such as child illness, have occurred".
