San Sebastian City Council accused of prevarication in the construction of Xabi Alonso's villa
The environmental associations Haritzalde and Ecologists in Action Gipuzkoa have denounced the City of San Sebastián to the Public Prosecutor's Office of Gipuzkoa for a crime of prevarication. They have explained that the City Council has unlawfully authorized the use of a publicly owned but restricted access route to facilitate the construction of Xabi Alonso's home Igeldo.
The land on which the villa was built did not initially have access to the public road, which is a prerequisite for obtaining an urban planning licence. In order to overcome this obstacle, the City Council of San Sebastián granted the construction company a special temporary authorization to use the route that serves the water reservoir in the area. Environmental organizations say that this authorization expired in March, but the company has continued to use the road without authorization.
In the complaint, the associations believe that the action of theCity Council could constitute a crime of prevarication and accuse the construction company of a crime of usurpation, and warn that the City Council is negotiating the reclassification of the road with the aim of legalizing access, which, in its view, would constitute an irregularity in its failureto comply with the general interest.
The construction licence was revoked by Administrative Court No. 3 of Donostia-San Sebastián and is currently awaiting a decision by the High Court of Justice of the Basque Country.
