The Ertzaintza arrested two men in Arrasate on Saturday, October 3, accused of sexually assaulting a minor, one of whom fled after being released by an Eibar court.
The day after his arrest, the two detainees were brought before a judge at which the Public Prosecutor's Office did not apply for pre-trial detention, so the judge ordered their provisional release, withdrawing their passports, and ordering the two men to appear before the judge the following day.
The Ertzaintza arrested the two men on charges of sexually assaulting a minor last Sunday and, after completing the proceedings at the police station, brought them before the Eibar guard court on Tuesday morning.
According to the EFE agency, citing sources from the High Court of Justice of the Basque Country (TSJPV), the detainees participated in the session held in Eibar, which was attended by the Public Prosecutor's Office and the defence lawyers of the accused.
The same sources added that without this request the judge could not issue a warrant for imprisonment and "with precautionary measures he agreed to his provisional release", in addition to ordering them to approach the Bergara court the following day.
On the 7th, only one of the alleged perpetrators of the sexual assault on the child appeared, andthe judge of Bergara ordered that person to be placed in pre-trial detention, and also issued a search and arrest warrant for the second male.
