In a judgment published this Tuesday, the Court of Justice of the European Union has stated that it is not enough for Spain to convert interinos into undefined non-fixed ones. Meanwhile, the Spanish Government has reaffirmed its commitment to reduce the temporality, stressing that it has already stabilised 419,756 places above its commitment to Europe.
According to the Spanish Government, the judgment of the Court of Justice of the European Union published this Tuesday on the provisionality is only 'illustrative'and states that it does not in any way oblige internationals in the public sector to become direct permanent workers. The final decision must now be taken by the Spanish Supreme Court.
The Court of Justice of the European Union (ECJ) has today ruled that the conversion of the interns who have chained temporary contracts with the administration in Spain into undefined non-fixed contracts is not a sufficient measure to punish such abuses because it 'implies a temporary employment relationship' and does not improve the worker's' precarious situation '.
The case is based on the situation of a worker in the Community of Madrid who chained six temporary contracts since 2016. The Spanish justice system acknowledged the abuse and made him an indefinite employee.
The case is now in the hands of the Spanish Supreme Court, which will have to make the final decision.
