The Government of Catalonia has imposed a pioneering penalty of 10,001 euros on a real estate agency for racismagainst a family who wanted to rent a flat. The victim is Hamid, a person of Moroccan origin residing in Mataró (Barcelona).
Hamid indicted 13 real estate agencies on the same charge because, despite all the requirements, they refused to rent a flat, most of which were filed after a series of bureaucratic procedures by public administrations.
However, after receiving assistance from the Desca Observatory, the Office for Equal Treatment and Non-Discrimination of the Generalitat (OITND) found that these real estate agencies had acted racially and opened the first administrative penalty files in September 2025. In that case, Hamid asked for information about a flat in early 2024, but the real estate agency replied that it was already rented, and then a colleague of Hamid's made the same request and the real estate agency replied that it was available, and they also agreed to a visit, but Hamid himself came to ask for an explanation of the difference in treatment.
The OITND resolution acknowledges that the facts complained of constitute a case of discrimination on the grounds of ethnicity or origin in access to housing . Social organizations consider this outcome tobe "a first step towards ending the impunity of racism in housing rental cases".
