Farewell to smoking on terraces and beaches: this is the new anti-smoking law, which equates the vaporizer with the cigarette
The new law passed by the Spanish Government prohibits smoking and bathing on terraces and beaches, since it equates electronic cigarettes with traditional tobacco and provides for fines of up to 600 euros.
The Spanish Government-led Tobacco Bill tightens the consumption and sale of tobacco and restricts the areas where smoking is permitted.
The main measures of the new regulation are as follows:
Where will smoking be banned?
- Beaches (the main novelty).
- The terraces of bars and restaurants.
- Pools for collective use.
- Sports facilities.
- National parks.
- Work vehicles (except for personal use only).
- Public entertainment venues, as well as outdoor venues (theatres, cinemas, concerts, etc.).
In what environment are they going to strengthen protection?
- Smoking is prohibited within a radius of at least 15 metres around access to the following areas:

- Public buildings.
- Health centers.
- Colleges and colleges.
- Research centers.
- Museums, libraries, cultural centers.
- Sports facilities.
- Parks and children's areas.
- A two-month period has been set for fitting the signals.
Equating With Bapee
The law equates the regulation of:
- E-cigarettes or vaporizers (with and without nicotine).
- Pipes.
- Grilled herbs.
- Nicotine bags.
- Other products related to tobacco.
Child protection
- The consumption of tobacco products and products associated with persons under the age of 18 is prohibited.
- The ban also affects vaporizers and other devices; nicotine bags are excluded from the regulation of smoke-free areas, but minors are also prohibited from consuming them.
Sales and advertising
- The sale of tobacco related products is limited to specialized stores .
- Restrictions on advertising, promotion and sponsorship have been tightened.
- Stalls and specialized shops may not display advertising or posters visible from outside.
What fines will be imposed?
- Minor offences shall be punishable by fines ranging from EUR 300 to EUR 600.
- In the case of minors, the parents or guardiansmay be subsidiarily liable and may replace the fine with work for the benefit of the community.
What does this law (for the time being) not contain?
- Generic packaging of packages (the Government will try to introduce them during parliamentary proceedings).
- Ban on disposable vaporizerspending favourable report from the European Commission.
Next steps
- The draft has been approved by the Council of Ministers in the second round and isnow being processed in the General Courts for amendment before final approval.
