The Public Prosecutor's Office has appealed the award of the third degree to Idoia Mendizabal
Sare has complained that this decision "has nothing to do with justice criteria."
The Public Prosecutor's Office of the National High Court has appealed the third degree of imprisonment granted by the Basque Government to ETA prisoner Idoia Mendizabal Mujika .
The appeal formalized on 1 October has a suspensive effect, so Mendizábal is back in second grade, but in application of Article 100.2 of the Criminal Regulations, he leaves the Zubieta centre where he is serving his sentence during the week.
After hearing about the appeal, Sare has complained that this decision "has nothing to do with justice criteria" but "revenge."
In a statement issued by Sare, he stated that Mendizabal was transferred to the third grade " on the proposalof prison professionals "and that those who appeal are judges and prosecutors who" know nothing about the evolution of prisoners ".
