Tolosa and Lezo have been declared strained housing areas
The declaration of strained areas makes it possible to extend a number of measures to facilitate access to housing, the most important of which is the possibility of setting the rent ceiling on the price range established by the Ministry of Housing according to a reference index adapted to each area, although the classification will not enter into force officially until it is published in the Official Gazette of the State.
The Official Gazette of the Basque Country (BOPV) published on Tuesday the declaration of Lezo and Tolosa asareas of the tense housing market , but this classification will not officially enter into force until it is published in the Official Gazette of the State.
In particular, the BOPV has issued an order from the Housing and Urban Agenda Counsellor, Denis Itxaso, to declare these two Guipuzcoan municipalities a tense area for a period of three years.
In order to designate a tense area, at least one of the two criteria laid down in the Housing Rights Act must be met. On the one hand, the cost of mortgage or rent, plus basic expenses and supplies, mustexceed 30% of the average income.
On the other hand, the increasein housing prices in the area by 3% over the CPI recorded in that autonomous community in the previous five years.
The declaration of strained areas allows for the extension of a series of measures to facilitate access to housing, highlighting the possibility of setting rent prices at the ceiling of the price range established by the Ministry of Housing according to a reference index adapted to each area.
This limit applies to all flats on the market which have not been leased in the last five years, as well as to all contracts of large possessors, i.e. persons holding five or more dwellings.
The declaration of strained areas also allows three extraordinary one-year extensions for contracts concluded, provided that certain conditions are met.
