The Basque Business Confederation(Confebask) has applauded the dismissal ofthe complaint filed by the High Court of Justice of the Basque Country (TSJPV) by ELA and LAB against employers for their ownInterprofessional Minimum Wage (SMI) .
In a statement, Confebask has stressed that the Court has accepted the argument put on the table from the outset by employers not to negotiate the minimum wage: is "the exclusive competence of the Government" to negotiate its own SMI and "the employer cannot legally negotiate this issue with the ELA and LAB unions, so Confebask has done its job.
In resolution the Social Divisionof the High Court of Justice of the Basque Country considers that the position of the employers is justified because it cannot negotiate this matter with the power stations.
The sentence is not final, and an appeal may be lodged with the Supreme Court.
