Tubos Reunidos has offered 42 permanent workers the possibility of joining voluntary leave under the conditions of temporary workers
The Labour Inspectorate, at a meeting held on Wednesday with the committee and the company, found that there were 42 to 47 temporary contracts made in Tubos Reunidos in breach of the law, so the company has had to make these workers permanent, which the unions explained had been extended until 31 March.
Tubos Reunidos has offered 42 workers who have become permanent by decision of the Labour Inspectoratethe possibility of joining voluntary leave in the EEC, buthas specified that has " egingnow.eus", i.e. 33 days compensation per year worked, with a limit of two years.
Last Wednesday, the Labour Inspectorate, in a meeting with the committee and the company, found that there were 42 and 47 temporary contracts in Tubos Reunidos for legal fraud and specified that the company had to make these workers fixed, which the unions explained had been extended until 31 March.
These 42 or 47 persons are among the 80 temporary persons counted in the 285 redundancies recorded in the Tubos Reunion Employment Regulation Dossier (ERE).
In a statement, Tubos Reunidos has assured that it extended the temporary contracts of these 42 persons, which expired in the days prior to the entry into force ofthe ERE, and has explained that the aim was to equate them with other temporary workers with whom the contract is in force and to "guaranteetheir right of representation in orderto obtain the same economic benefits as those determined for this group in the ERE ".
He adds that, following last Wednesday's meeting at the Labour Delegation in Vitoria-Gasteiz, the Labour Inspectorate has informed Tubos Reunidos that "although there was no bad faith in the implementation of these 42 contract renovations ", they had no legal reason to remain temporary, so" they would bede facto indefinite contracts ".
For all these reasons, he has assured us that he wants' these people too 'to respect and announce the voluntary conditions he has put forward since the start of the negotiation, that the 42 people who were previously temporary and who had not been able to join the offer of voluntary leave made by the company for indefinite workers will now be able to join that offer.
If they take voluntary leave, these 42 workers may leave the company on 31 March under pre-established conditions for temporary workers , i.e. 33 days' compensation per year worked, with a limit of two years.
He added that if Tubos Reunidos were to obtain the necessary resources for the incentive leave scheme, these 42 people would also receive a "similar improvement" in the conditions received by permanent workers who voluntarily leave the company, i.e. 45 days per year worked, with a 24-month limit, plus a linear of 1,500 euros with a maximum of 10 monthly wages.
