Thereal estate company Alquiler Seguro real Estate has reported that it will appeal to the courts the fine of 3.6 millioneuros that the Ministry of Consumption and Agenda 2030 has confirmed on Wednesday for "abusive actions against tenants".
The company considersthe Ministry's decision to be "unfair and arbitrary"and advances that it will file a contentious administrative appeal. It argues that all the services it provides are legal and stresses that this has been confirmed so far by four court rulings.
On Wednesday, the Ministry announced the resolution signed by Minister Pablo Bustinduy himself, which has made the proposed fine against this real estate firm in 2025 and confirmed the conclusions of the penalty file opened by the Directorate-General for Consumer Affairs following several complaints filed by Facua, the Tenant Union and the OCU.
According to the resolution, the real estate company committeda very serious and serious infringement of the six by "taking advantage of market dominance" by violating the rights of consumers.
Actions have been punished, such as imposing on the tenant the costs inherent in the landlord, imposing the tenant's care service, forcing him to take out his home insurance, or imposing charges for claims not attributable to the tenant.
It also punishes the addition in contracts of the possibility of entering into files of defaults or defaults without due debt, as well as the limitation of the right of withdrawal in certain contracts.
The fine imposed amounts to a total of EUR 3.6 million, but it is divided into various amounts depending on the offence and obliges the company to make corrections and remove abusive terms.
The Ministry has reported that an investigation is continuing into another case opened to another real estate agency for similar acts.
