The ruling handed down by Eibar Social Court No. 1 is pioneering in the Basque Country, as it is the first time that career staff have been granted the right to compensation for abuse of temporary contracts.
A court in Eibar has sentenced the Basque Government to compensate two permanent workers in Lanbide for "abuse of temporary contracts" on the basis of the doctrine established by the EU Court of Justice on 14 April. UGT has explained that this is a pioneering judgment in the Basque Country. This is the first time that workers have been granted the right to compensation for abuse of temporary contracts.
According to the judgement, Lanbide must compensate two Lanbide workers (regardless of the costs of the proceedings) with €45,938 and €39,401, who were in a situation of temporary recruitment fraud for more than 10 years, until they obtained permanent employment through the stabilization process in 2022.
