The trade unions' claim against the regulation of the company's records became meaningless when the insolvency administrator announced that it would not apply.
The Social Division of the Basque Country has shelved the trade union complaint filed against the regulation of the file of Tubos Reunidos after the unions withdrew the application after the insolvency administrator announced that he would not apply the measure.
An oral hearing was to be held in July at the TSJPV on this regulation of the case, but after taking over the company, the insolvency administrator — a member of the consultancy PKF Attest — informed the unions that the regulation of the case would not apply, since it had never been implemented.
For this reason, the plaintiffs — the unions ELA, LAB, FICA-UGT and ESK — and the defendants — Tubos Reunidos Group and PKF Attest, as the insolvency administration — filed a joint brief before the court requestingthe filing of the proceedings, by mutual agreement, for the "disappearance of the subject matter of the case".
The Ministry of Public Prosecutions also submitted a written statement stating that it did not object to the conclusion of the proceedings, and the Social Chamber has therefore decided to dismiss the case.
