Several ministers of the Spanish Government and the President of Andalusia have expressed concern about the psychological situation of the boy. On the other hand, Rivas's eldest son has filed a complaint against his father for an alleged offence of coercion of the will of his younger brother.
The Granada High Court has upheld an appeal filed by Juana Rivas's former partner and ordered an investigation into the theft of minors, while the couple's eldest son filed a lawsuit against his father and a psychologist for attempting to coerce his younger brother's will.
Juana Rivas lives in Maracena (Granada) and issentenced to two and a half years' imprisonment for separating her two sons from her ex-husband Francesco Arcuri, after which she was granted a partial pardon .
Last Tuesday the youngest son was to be left with his father at a family reunion in Granada, following an order from an Italian court, but this reunion was postponed to Friday, 25 July.
On Thursday, the GranadaCourt partially upheld an appeal against the decision to file a complaint filed by Francesco Arcuri against Rivas for theft and ill-treatment of minors.
On the other hand, theeldest sonof Rivas and Arcuri , who is of age, has filed acomplaint bat againsthis father and a psychologist accused of coercing the will of his younger brother at the meeting on Tuesday.
It also requests in the complaint thatprecautionary measuresfor the protection of minors be taken as a matter of urgency, such as thesuspension of the restraining order and the order to accompany the father.
At this point, he refers to a statement made by the minor in January 2025, describing "the physical and psychological abuse inflicted on him by his father", adding that "he has often expressed to various authorities his willingness to live with his mother and brother in Granada".

Finally,thepolitical secretary and MEP of Podemos Irene Montero has said that the government must guarantee the best interests of the child and avoid returning to Italy with his father by applying the exception of the Hague Convention.
