After the investigation into Maialen Mazon's murder, the defendant is asked for 45 years in prison
Both in Vitoria-Gasteiz and in Basque society as a whole, the case caused a chill in 2023. The head of the Women's Violence Court in Vitoria-Gasteiz has completed the investigation of the casefor the murder of Maialen Mazon,who on 27 May 2023 was allegedly stabbed to death by his former partner in a 33-year-old Vitorian apartment in the Alavesa capital.
The victim was pregnant with twins at the time of the murder, and the attack took placein frontof her two-year-old daughter .
His alleged murderer, Jaime Roca, a 33-year-old Valencian, wasarrested thefollowing day at a toll in Zaragoza while trying to flee by taxi to Valencia.
At the time, in addition to the pain, the case caused a great deal of controversy when\ u00A0 revealed the shortcomings of the protocol used by the Ertzaintza to protect women who suffer abuse , as Maialen appeared as a victim of "extreme risk" in the VioGen system, while in the Basque Country it was considered "low risk".
Thelawyer of the Clara Campoamor Association, Cecilia Piris , has stated on Radio Euskadi that "this was a huge mistake of the Ertzaintza in caring for this woman", precisely the protocol that was corrected after this case: "If she were to enter the Basque Country now, she would receive a risk assessment from the external police, so that she would come from outside with a very high risk rating."
The prosecution and the popular prosecution are asking for the maximum penalty for Maialen's ex-partner, 45 years in prison. Piris has stated that "we have not asked for more because the Penal Code does not allow us, 25 years would be for Maialen's murder, 8 years for each abortion, and another 4 years for the abandonment of the minor."
Upon completion of the investigation of the case, the selection of the jury shall be followed and the date of the trial shall be determined for the first half of next year.
