The High Court of Justice of the Basque Country (TSJPV) has upheld the 25-and-a-half year prison sentence imposed on the man convicted of the murder of a man in Bilbao who met the deceased through an app. Gizona is being investigated for four other similar murders.
With this decision, the TSJPV fully confirms the judgement handed down by the Bizkaia High Court, finding it proven that the convicted person killed his victim on 17 October 2021 using the "mataleon" technique.
The accused alleged in his appeal that there was insufficient evidence to undo his presumption of innocence. However, the Public Prosecutor's Office and the private and popular indictments (Gehitu Association) defended the consistency of the jury's decision and requested its confirmation.
The TSJPV emphasizes in its resolution that the jury based its decision on "consistent and non-irrational" evidence, including the finding of the defendant's phone at the scene of the crime and the expert who identified him as the person who called a bank using the victim's mobile phone. It also supports the assessment of the Ertzaintza's intelligence report linking the convicted person to other similar events in Bilbao.
The judgement of the High Court of Justice of the Basque Country is not final and may be appealed in cassation to the Supreme Court.
