A court in Donostia-San Sebastián has annulled the request for the C2 profile of the Basque Country in all administrative posts of the Government of Gipuzkoa
In the words of the CCOO union, the ruling is based on the fact that the demand for this profile in 100% of the places on that offer causes "disproportionality".
A court in Donostia-San Sebastián has suspended the applicationfor the HE4-C2 language profile of the Basque Country for all jobs in the public employment offer launched by the Provincial Council of Gipuzkoa for technicians of the General Administration , as reported by the CCOO union of the Basque Country.
The decision has been taken in the first instance, but the Provincial Council of Gipuzkoa will not appealit. It stresses that it is hoped that the legislative reform under discussion in the Basque Parliament will ensure the legal certainty of language profiles.
According to the statement published by CCOO on its website, the judgment is based on " onthe disproportionality of the determination of the Basque profile in 100% of administrative posts ", a figure which, in the opinion of the union," clearly and unjustifiably exceeds the mandatory sociolinguistic index ".
It further considers that "linguistic and labour rights may be perfectly compatible with respect for sociolinguistic proportionality". According to its calculations, the Council should determine the Basque profile in 63.2 per cent of the jobs, rather than in all of them.
According to sources from the Council, these 34 places will have to be offered in a new OPE and will be followed by the criteria set in October, which will delay the accreditation of the Basque language in one third of the places.
