Two young men have been sentenced to five years in prison for attempting to kill a minor in San Sebastian
The two defendants have accepted the facts and reached an agreement with the Public Prosecutor's Office, so that instead of 12 years' imprisonment, they have been sentenced to five years' imprisonment, and for six years they will not be able to approach or contact the victim.
Judge Jorge Juan Hoyos, during today's session.
The judge has sentenced the two young men indicted last year for attempting to kill a minor with a knife outside a school in Donostia-San Sebastián to five years' imprisonment. The youth defence has reached an agreement with the Public Prosecutor's Office and the defendants have admitted the facts.
On charges of attempted murder, the Public Prosecutor's Office requested 12 years' imprisonment for the two defendants, one as the alleged perpetrator and the other as the alleged perpetrator. The prosecutor also took into account an aggravating circumstance, both of which were covered at the time of the incident.
They've finally been convicted of murder.
As a result of the agreement, the Public Prosecutor's Office has amended the indictment and charged both of themwith attempted murder and applied mitigating measures, since both have paid part of the compensation to the victim (one of 1,200 euros and the other 600 euros). In addition to the prison sentence, the judge has prohibited them from approaching and contacting the victim for six years.
According to the Public Prosecutor's Office, 15 days before the attempted murder, a girl told her partner that a classmate was "trying to seduce her." When she heard it, the young man became angry and " decided to kill the minor with a hunger for revenge. "
The young man told two people, one of them a minor, of his intention, and among the three, they prepared a "plan to kill" the victim. In the following days, the young man obtained a photograph of the victim, and to commit the murder he obtained black gloves latex, balaclava of the same colour and a large kitchen knife. On March 13, at 3:45 p.m., the four men (two adults and two minors) went to the school in San Sebastian, and when they had finished their classes, they approached the victim and threw themselves at him.
The victim managed to escape, but was stabbed several times and, while trying to escape, was again attacked by the assailants, resulting in multiple injuries to the victim.
In the same case, two other minors were convicted last year.
Two other defendants in the same case, both minors, were tried in December last year, who also accepted the action and reached an agreement with the Public Prosecutor's Office during the session held at the San Sebastián Juvenile Court. One of them was convicted of attempted murder and must remain in a closed juvenile facility for two years. The other was charged with the offence of necessary collaboration and sentenced to one and a half years.
