Justice has convicted the insurance company of the capture of Aulestin Iurgi Beraza in 2020
The child's parents have expressed their pain and disagreement with the resolution, which "is by no means sufficient in terms of scope or reasoning", but have refused to appeal the sentence out of respect for judicial decisions, but also because of the "need to put an end to a long, painful and emotionally destructive process".
After almost six years of judicial proceedings, theodyssey for the parents of Iurgi Beraza Uriarte, the 11-year-old boy who died in May 2020 after being trapped in front of his home in Aulesti, hasended. The parents of the minor, Josu Beraza and Agurtzane Uriarte, have expressed their "pain" through a note and have argued "respectfully but firmly" that they do not agree with the outcome of the proceedings because, in their view, the sentence "is insufficient in terms of scope or reasoning, and does not give the measure of the complex reality of what happened or the gravity of the facts ".
During the proceedings, the family has denounced "serious errors, contradictions and irregularities", such as the initial police report, which described the facts as "unfortunate" without a thorough technical investigation or a clear allocation of responsibility, as well as the absence of key elements in the initial investigation or the existence of conflicting expert reports.
The parents consider it particularly serious that , five years afterthe incident, the officer in charge of the initial report declared at the judicial headquarters that the minor was not wearing a helmet when it was not included in the original report, although it has now been considered an "important element", which, in their view, "seriously compromises the reliabilityof the investigation "and causes" deep concern "about how to reconstruct the facts.
However, they have ruled out appealing the sentence out of respect for judicial decisions, but also because of "the human need to put an end to a long, painful and emotionally destructive process."
They say, "Even if it were a million euros," the money could never compensate for his son's loss: "We don't want money, all we've always wanted is to know the truth, and now, for once, we've known the truth. "
They hope that this case will serve to reflect on the need to conduct investigations with the utmost rigour, consistency and transparency in fatal accidents.
The note ends with the phrase: "Iurgi was neither a figure nor a file. He was a child, a son, and his memory deserves truth, respect and justice."
Six years without Iurgi
In May 2020, in the midst of the coronavirus pandemic confinement, a car hit Iurgi and killed him in the Zubero district of Aulesti.
The accident occurred around 20:37 on a mountain road, at which time only the children could go out on the street.
According to the minor's parents, the car that hit him was speeding too fast.
Iurgi's parents have been seeking justice ever since.
After that, civil proceedings were initiated, which have now ended, in which was claimed compensation from the insurance company for the vehicle that caused the hit-and-run.
