Judge exonerates six of those tried for crimes against the moral integrity of a Zestoa man
The judge has acquitted and acquitted the six neighbours of Zestoa who were tried at the San Sebastián High Court last December for alleged offences against the moral integrity of a man in Zestoa. In the words of the judge, it cannot be proved that the accused persons coerced the complainant with the facts described and declared proven, nor that their actions undermined the moral integrity of the complainant as reported by the man.
The case originated in 2018, when a man charged his ex-partner and five other citizens, four close friends of the girl and current mayor, Mikel Arregi, with a crime against moral integrity. In the case they both had with their ex-partner over custody of their child, the man accused the five defendants of conducting a campaign of disrepute in the village between 2016 and 2018.
The complainant explained that the defendants harassed and pressured her to refuse joint custody of her son, and that they engaged in rallies and other acts against her, claiming that she mistreated the woman.
At the trial, however, the defense raised doubts about this possible campaign, and his ex-partner, asked by the prosecutor, made a crude accusation of years of mistreatment .
At the trial, the woman stated that she had never dared to report such ill-treatment for fear of what might happen to her son. Some of the defendants, friends of the man's ex-partner, helped the woman to leave or pick up the child from her father and denied having pressured or harassed the man.
After the woman's statement, the prosecutor decided to withdraw her main charges, maintaining the financial fine (down from 30,000 initially to 15,000).
The prosecution upheld its requests for four and five years' imprisonment and the request for compensation of EUR 30 000.
Now, five months after the trial, the judge has proved the defence right and acquitted the six citizens of Zestoa of all the crimes charged. They will not even have to pay the financial fine requested by the prosecutor.
