Sentenced to 12 years and 6 months in prison for raping his roommate in Navarre
The victim, 34, and her two daughters were in a very vulnerable situation and had to continue sharing a flat with the aggressor, who again abused her.
The Second Section of the Navarra High Court has sentenced a man who raped his roommate in Tudela in March 2024 to 12 years and 6 months in prison for a crime ofrape and 3 years and 6 months for an offence of unauthorized touching.
In addition, the convicted person, who is 47 years of age , may not communicate with or approach the victim less than 200 metres , 18 years and 6 months, or serve another 9 years of probation and compensate him with civil liability of 15,000 euros for moral damage caused.
An Account of Events
In February 2024, the woman went with her two young daughtersto a rented room in Tudela, to the same house where the accused lived, and the sentence found the victim in a very vulnerable situation, with difficulty communicating in Spanish .
In March of the same year, the man invaded the woman's space and sexually assaulted her twice, and was aggressive with humiliating and derogatory behaviour.
Pressure on the victim
In the judgement, the Second Section of the Tribunal asserts that the evidence produced undermines the presumption of innocence of the accused. The judges also highlight the "credibility and conviction force"of the victim's account.
Moreover, the witnesses — the police and the aid volunteers — confirmed that the accuser was deeply disturbed and distressed in explaining the facts.
On the other hand, the court points out that there is "an important element" in this procedure to corroborate the account: the audios of communicationsbetween the persons involved through social networks , which show that the defendant 's environment tried to pressure the victim not to file a complaint.
The judgement handed down by the Second Section of the Navarre High Court may be appealed to the Navarre High Court of Justice.
