The Public Prosecutor's Office has appealed the secondsemi-liberty regimegranted by the Basque Government to ETA prisoner Marisol Iparragirre, Anboto, pursuant to Article 100.2 of the prison regulations.
For the first time, the open regimewas approved in March, but a month later, the Prison Supervision Judge of the National High Court, José Luis Castro, declared it null and void.
On 2 September, the Basque Government took into consideration the "unanimous" proposal of the Zubieta Prison Treatment Board and for the second time granted semi-liberty to the Eskoriatzarra prisoner.
Under this regime, he is allowed to leave the prison at a certain time, to do some voluntary work, and in the afternoon he must return to the prison to sleep, during the week and on weekends
In the note issued today, the Public Prosecutor's Office states that the prisoner's situation has not changed since April and therefore maintains the pre-established judicial criterion, and that there is no reason to review his situation.
In addition, according to the prosecutor, the arguments put forward in both appeals are the same, namely that the conditions laid down in Article 100.2 for the semi-release of Iparragirre are not met, including those relating to the voluntary work of the prisoner on the streets.
Thus, the case has again reached the hands of the Prison Supervision Judge of the National High Court, José Luis Castro, who will have the last word.
