The Spanish Government approves a regulation allowing aid to victims of asbestos
The Council of Ministers has adopted the Royal Decree, with the regulation of the Compensation Fund, two and a half years after its adoption, although the deadline for its adoption is three months, and it will enter into force three months after the publication of the rule adopted today.

The Minister of Education, Vocational Training and Sports and spokesperson for the Spanish Government, Pilar Alegría , has advanced the adoption of this regulation establishing the conditions and procedure for the recognition of the right to financial compensation for the victims of this carcinogenic agent responsible for asbestosis or lung cancer.
It shall enter into force three months after the publication of the regulation and provides for compensation of between €32,000 and €96,000 in single payment, depending on the pathology suffered by exposure to asbestos.
"We know that much damage is difficult to repair, but listening to the victims and getting that mechanism was primarily a matter of justice for all," Alegría explained.
The text, as detailed in a note by the Ministry of Social Inclusion, Social Security and Migration, recognizes the status of beneficiary in several cases.
Firstly, those who have a strong administrative or judicial recognition of a permanent disability pension resulting from occupational illness caused by asbestos, or who are entitled to compensation by a final court decision.
Also those who have a disease covered by the rule and those who have received the rights of those who have it recognized.
Among the requirements for applying for a grant is that derived from a pathology caused by exposure to asbestos: mesothelioma, lung or laryngeal cancer, or asbestosis with moderate or severe functional impact.
Six months.
The persons concerned, as explained by the Spanish Government, must apply to the Department of Health or the relevant Community Advisory Office for a certificate of diagnosis of the pathologies resulting from exposure to asbestos.
Once the certificate has been issued, they may submit an application to the National Social Security Institute, which must decide within six months.
If there is no express reply within that period, silence shall be deemed to be a refusal of aid, and the applicant shall therefore not be compensated.

The amount shall be determined by applying the scale established by the Social Security according to the pathologies resulting from exposure to asbestosis: €32,207 for asbestosis, €48,310 for laryngeal cancer, €64,414 for lung cancer and € 96,621 for mesothelioma.
