The Supreme Court rejects Koldo Garcia's request to ban the publication of his audios
The examining magistrate has stated that he is not competent to take these precautionary measures and has reminded him that he did not object to Santos Cerdán's request that the audio be taken out in its entirety for the case, which was found on three mobile phones and a tape recorder at Garcia's home and which, once removed, has been handed over to the parties.

The investigating judge of the Supreme Court investigating the "Koldo Case", Leopoldo Puente, has rejected Koldo García's request for the judicial seizure and prohibition of the publication of audios found in his home register.
These audios were foundon three mobile phones\u00A0 and a tape recorder and delivered to the parties involved in the process, after being removed and prepared on 23 and 24 July. This is more than 22,000 messages.
Garcia called for the judicial, precautionary and immediate seizure of audios of a personal and intimate nature that are not directly related to the investigation of the case, as well as the prohibition of the dissemination of such audio, especially to the media. In his defence's view, "the dissemination of voice notes related to his most intimate environment is a very serious interference in the fundamental right to personal privacy".
The instructor states that heis competent to take such precautionary measures, and that Garcia may make the same request before the competent judicial body.
He also explains that the decision was taken to extract all the audios and prepare them for the case at the request of former PSOE Secretary of Organization Santos Cerdán, in order to articulate his defence in its entirety. He reminds Garcia that when the parties were informed of the decision, his defence joined this request.
In the Judge's view, it is "deplorable" that a large part of the proceedings carried out during the investigation of this case have been leaked to the Commons, but he adds that it is not for him to investigate the anti-legal nature of these leaks.
These recordings are contained in a report by the Central Operational Unit of the Civil Guard (UCO), which led the judge to send Santos Cerdán to pre-trial detention on 30 June, on the understanding that he is being placed as the alleged leader of the public works award network.
