The alleged disclosure of secrets related to the Attorney General of the State, Alvaro García Ortiz, is being investigated by theSupreme Court in connection with the case of thebusinessman Alberto González Amador and his partner Isabel Díaz Ayuso Madrid, following the dissemination of an e-mail to the press.
In his testimony as a witness on 23 May, Gonzalez Amador stated that he had entrusted Rodriguez with the decision to send the prosecutor's mail tothepress. "Do what you think," he replied, when asked if his lawyer had any objection to the dissemination of a message received in which the prosecutor, Julian Salto, stated that he saw no "obstacle" to reaching an agreement in the proceedings investigating the businessman for alleged tax fraud .
Gonzalez Amador explained that his intention was to conduct the proceedings "with as little noise as possible"and stated that he had never been consulted on the message his lawyer had sent to the Public Prosecutor's Office, offering an agreement in whichhe acknowledged the fraud, and assured him that he had learned of the contents of that message through the press, and reacted with "great anger" to the fact that, in his words, he was publicly dismissed as a "confessed fraudster. "
Rodriguez, who testified in the Supreme Court on 8 January for the alleged leak, described the charge against the Attorney-General as a "personal deduction." He added that only two parties had access to the file, the Public Prosecutor's Office and the lawyer of González Amador. He concluded that, on the grounds that he had not been a lawyer, it should have originated from the Public Prosecutor's Office.
In his statement to the Supreme Court on 29 January, García Ortiz categorically denied the complaint, as well as the fact that he had given, disseminated or communicated the tax file or any message concerning González Amador.
The presentation of the images of these statements, which the court has just authorized, brings new nuances to the case. The defenses and indictments will have access to them for the trial scheduled for November. In November, the Attorney General ofthe State, Alvaro García Ortiz , will face a request for a sentence of between four and six years' imprisonment for a crime of disclosure of secrets.
The businessman insisted on his desire to be treated like "any citizen"and argued that he provided information to Rodriguez to protect his partner because he felt used to attack Ayuso. He also denied having committed fraud, but agreed to join his lawyer's legal strategy when he understood his point of view.
