This Monday begins the trial of Maialen Mazon's alleged killer
Scheduled until the 15th, it will begin with the election of the popular jury. The prosecution requests 45 years' imprisonment for the accused.
The alleged murderer of Maialen Mazon will be tried from this Monday by a popular jury in the Provincial Court of Álava. The 32-year-old woman was pregnant with twins at the time of her murder and was found with her three-year-old daughter, who was unharmed.
The Public Prosecutor's Office requests 45 years' imprisonment for the alleged perpetrator, 25 of them for murder with alevosy and cruelty (he stabbed the woman), another eight years for two offences of abortion, and another four years for abandonment of the minor (his daughter was unharmed).
The murder took place on May 27, 2023, in an apartment on Gasteiz Avenue in the Alavesa capital, but was found the next day.
Maialen Mazon's ex-partner, 33, at the time of the murder, was arrested hours later by the Civil Guard at the AP-68 toll in Alagon, Zaragoza , while fleeing in a taxi to Valencia.
The victim had an open file of the Spanish National Police for gender-based violence and a court in Torremolinos, Malaga, had issueda restraining order against the woman.
The murder provoked a long string of reactions in the police and legal field. In fact, questioned the Ertzaintza's support for the victim because the Ertzaintza knew that the woman and the alleged murderer lived together.
After Mazon's return to Vitoria-Gasteiz, the Ertzaintza contacted him twice, in January and 10 days before his death, and the woman told the agents that she was not in danger andthat the violation ofthe restraining order was "consented", as reported by the then Security Adviser, Josu Erkoreka.
However, other State Security Forces stressed thatviolating a restraining order issued by a\u00A0 court is a criminal offence in all cases, regardless of whether the victim to be protected agrees to approach the aggressor.
In addition, Mazon appeared at 'extreme risk' to monitor cases of gender-based violence in the state system, the VioGen system, and theErtzaintza lowered the level of risk to 'low risk'.
The trial will take placefrom 4 to 15 May at the Provincial Court of Álava. The first session, this Monday, will be to elect the members of the jury, and if time permits, there may be a statement.
