A U.S. court of appeal has declared Trump's tariffs illegal, but they remain in force
This is the second judicial blow to Trump's tariffs, which confirms a New York commercial court ruling in May.
A federal appeals court in the United States ruled on Friday that President Donald Trump had no legal right to impose tariffs and that those imposed on most countries are illegal, but that the measure remains in force pending a government appeal.
Trump's tariff policy will remain in effect until mid-October because he wants to allow the Trump administration to appeal to the Supreme Court of Justice.
The president, at Truth Social, has advanced that he will file an appeal: "ALL TARIFFS ARE IN EFFECT! Today, a partisan court of appeal mistakenly said that our tariffs should be abolished, but they know that the United States of America will eventually win. "
However, today's ruling is the second judicial blow to Trump's tariffs, and confirms the verdict handed down in May by a New York commercial court .
The decision confirms that Trump "abused" when he used a 1977 law, the International Emergency Economic Powers Act (IEEPA), to impose customs taxes. The law was designed to be used only in emergency cases, according to the judgment's argument.
The resolution includes the tariffs that Trump applied under the said law , including the toughestandmost controversial tariffs applied against China, Canada and Mexico . It also includes the rates approved by the President in the last month, including those imposed on India.
Those imposed by Trumpon vehicles, steel and other imported goods are excluded from the court ruling because they were admitted under another law.
