ESK denounces attempts to change the work schedules of Tubos Reunion without following the legal procedure

Theunion\ u00A0ESK has denounced that the management of Tubos Reunidos intends to modify the work schedules in different areas of the company without following the legal procedure . In this regard, they have pointed out that the proposed changes are substantial changes to the working conditions and should be dealt with in accordance with the legal procedure envisaged , recalling that the company is in competition with creditors.
In a statement, the union has explained that the company has submitted to workers' representatives a proposal to amend the work schedules for steel, lamination, finishing, logistics and maintenance, a measure that affects aspects such as shifts, breaks, conciliation or occupational health, so this union considers that this measure cannot be considered as a simple organizational adjustment.
Furthermore, since Tubos Reunion is in competition with creditors, any collective changes of this nature must be dealtwith through the relevant legal procedure, with the necessary documentation, a period of consultation, the intervention of the insolvency administrator and the judge and the justification of the alleged cases, as stressed by the ESK union.
In this regard, the ESK union has accused the management of attempting to reach an agreement with the works council to implement the changesfrom 1 September without resorting to the relevant procedure, which, in its view, would be "a shortcut outside the ordinary legal route, while once again endangering fundamental labour rights".
It also criticizes the company's attempt to justify the changes it intends to introduce by referringto organizational problems which, in its view, could have been made earlier through the mechanisms provided for in the legislation.
The ESK union believes that this measure would have a negative impact on the rest and health of the workers concerned.
On the other hand, it has denied that the adoption of these amendments can be presented as a condition for ensuring the viability of the company and has argued that the protection of labour rights is compatible with the defence of employment and the industrial future of Tubos Reunion.
The union has announced that it will transfer this matter to the insolvency administrator atthe meeting scheduled for 14 July , which will also address other outstanding issues such as days of free disposition, outsourcing of the health care service and other issues related to workers' working conditions.
