The Spanish Government will today approve the extraordinary regularization of migrants
Foreigners in an irregular situation may apply for regularization from the beginning of April to 30 June. The processing shall last no more than three months, but may only begin to work by accepting the application.
Except for surprise, the Spanish Governmentwill today approve the extraordinary regularization of migrants. The agreement on the subject was announced in January by PSOE and Podemos, and the measure is expected to benefitmore than half a million people.
In statements to the media yesterday,theMinister of the Presidency, Relations with the Courts and Democratic Memory, Felix Bolaños reported that the technicians of the Ministry of Social Integration, Social Security and Migration are putting the finishing touches to the royal decree, taking into account the observations made by the Council of State.
The minister insisted that the measure is an "act of justice" and that thousands of people working "without rights" will now "contribute to Social Security and Finance." In his words, the welfare state will have "more resources" thanks to regularization.
In its resolution, the Council of State has generally approved the text drawn up by the Spanish Government, with particular emphasis on its 'unifying nature'. In any event, it has sent a number of observations to the group of experts who have drafted the measure in order to 'improve' the text, including the proposal to 'adapt' the procedure to ensure that the beneficiaries have no criminal record.
According to the text, if the person requesting regularization fails to obtain the certificate certifying that he or she has no criminal record within the period of one month requested, the Spanish Government shall have another month to obtain it, and if the latter fails to do so, it shall be sufficient, exceptionally, to submit the "responsible declaration" of the person concerned.
The Council of State has warned that the formula of the responsible declaration is not appropriate to address the situation of so many thousands of people. According to this body, the condition of the criminal record 'may lose weight' when in itself such a request is' reasonable '.
Processing period
Foreigners in an irregular situation may apply for regularization from the beginning of April to 30 June , with a maximum duration of three months, but may enter into work only by accepting the application, a procedure which shall be extended for a maximum period of 15 days from the date of application.
Authorization or approval of regularization shall include residence and work permits and shall be valid throughout the State and in all sectors. The initial permit shall be in force for one year and may then be used for the purposes provided for in the Aliens Regulations.
