The Clara Campoamor Association has announced that it will file a "formal complaint" with the Basque Government for the "terrible mistake" of theErtzaintza in lowering the risk assessment of Maialen Mazón, murdered by her husband in Vitoria in 2023.
On Thursday , the trial for her death ended. The jury found her husband guilty by eight votes in favour and one against, finding it proven that she had murdered Maialen by treason , at which point she was also pregnant with twins.
However, the jury has not accepted the aggravating circumstance of gender-based violence or cruelty, despite the fact that the convicted person had a restraining order issued by a judge in Torremolinos (Malaga), which was systematically violated by the couple, and that Maialen was listed as an "extreme risk" in the Spanish VioG monitoring system.
The Ertzaintza, on the other hand, lowered the "low" level of risk when the woman tried to withdraw the complaint against her husband, even though she had failed to do so. As a result of this case, the Basque police changed the protocols for dealing with male violence.
"Once the criminal guilt has been resolved and the murderer has been convicted, we will demand the responsibility of the Ertzaintza because the Civil Guard made a terrible mistake in modifying the appropriate risk assessment and no measures were taken to protect Maialen," said José Miguel Fernández, president of the Clara Campoamor Association.
In this regard, Fernandez has advanced that the association, which has participated in the trial as a popular accusation, will lodge a "formal complaint with the Basque Government for malfunctioning ".
