Supreme Court Judge Leopoldo Puente has refused to release PSOE Secretary of Organization Santos Cerdán, who has been in pre-trial detention since 30 June, on the grounds that the risk of destruction of evidence persists.
Santos Cerdán requested his release on the 8th after 70 days in pre-trial detention for his involvement in the Koldo case. He considers the investigation to be "unlimited" and seeks to "incriminate activities involving political participation".
But the magistrate, in agreement with the Public Prosecutor's Office and the People's Prosecution, points out that it is not appropriate at the moment to change this situation, and therefore rejects Cerdán's letter.
It further anticipates that in this case there is a risk of destruction of evidence, but that pre-trial detention will not last longer than six months, and that this period "will probably not have to be exhausted" if the grounds justifying the adoption disappear earlier.
The judge also points out that there is still reason to believe that Cerdán may have committed offences of membership in a criminal organization, influence trafficking and bribery.
