The Spanish Government will propose a reform of the Constitution to introduce abortion as a right

Government sources have specified that the reform will establish that all information provided in the field of abortion must have an "objective scientific basis" and be protected by "standards of international organizations" such as the World Health Organization (WHO) and the American Psychiatry Association (APA). "" Theories without a scientific basis, such as so-called "post-abortion syndrome", would have no place in these classifications, "the executive has warned.

The Spanish Government will propose a reform of the Constitution to include the right to abortion in order to "strengthen the freedom and autonomy of women", according to government sources.

The Government's announcement comes after the plenary of the Madrid City Council approved, with the votes of the PP and Vox, an initiative of Santiago Abascal's party that involved informing women who request termination of pregnancy about 'post-abortion trauma'.

In response, the Sánchez government announced on Friday that it will prevent women wishing to terminate their pregnancy from "receiving false information or without scientific evidence" and will push for this constitutional reform.

"In the global context of the offensive against sexual and reproductive rights, Spain has taken a further step towards establishing the freedom of women and their autonomy to decide on their lives," the sources added.

To this end, the Government shall promote the ordinary procedure for amending the Constitution, which shall be sufficient for a qualified majority to be adopted.

"The PP has decided to join the far right, they will see what they do, but not at the expense of women's freedoms and rights," Spanish Prime Minister Pedro Sánchez has posted on the X social network.

"With this government, in social rights, not a single step backwards," he added.

For this reason, "the Government shall prevent the transmission of false or misleading information to women who wish to terminate their pregnancy, beginning with the amendment of Royal Decree 825/2010".

And it will bring to Parliament a proposal to "constitutionalize the right to voluntary termination of pregnancy, in line with the jurisprudence of the Constitutional Court", adds the message published by the President of the Government.

With the proposal of the Government of Pedro Sánchez, Spain  would be thesecond countryin the world  to enshrine the right to abortion in its Constitution, following the path taken by France in 2024. According to the Government, the aim is "to combat any setbacks that threaten women's rights".

Government sources have specified that the reform will establish that all information provided on abortion must have an "objective scientific basis" and is supported by "standards of international organizations" such as the World Health Organization (WHO) and the American Psychiatry Association (APA). "Theories without a scientific basis, such as post-abortion syndrome, would have no place in these classifications," the Government has warned.

With the measure, the Government has stressed that it faces "any attempt to delay the future that threatens women's rights."

They also recall that the Constitutional Court itself recognized initsjudgment 44/2023  the voluntary termination of pregnancy as a "fundamental right" of women.

Thus, "the Spanish Government will continue to address all avenues to prevent women who wish to exercise their right freely from being subjected to any kind of pressure. In this way, they stress, our country will remain an international benchmark in the defence of women's rights and freedoms. "
