On Thursday, the Strasbourg Court condemned France for failing to provide adequate medical treatment to former ETA member Ibon Fernandez Iradi, 'Suspener', who is suffering from multiple sclerosis.
In the judgment, the European judges stress that the failure to provide adequate care for the disease, which was a condition for keeping him in prison, contravenes the article of the European Convention on Human Rights prohibiting inhuman and degrading treatment. Along with the sentence, France must compensate the prisoner with EUR 10 000 for moral damage and EUR 11 840 for the costs of judicial proceedings.
Fernandez Iradi (54 years old) has been in prison since his arrest in France in 2003, where he was sentenced to two sentences of 30 years and one of 15 years, although he was eventually reduced to 30 years, of which 20 were to be spent in prison.
In December 2012, he was diagnosed with multiple sclerosis and in March 2013 submitted a request to suspend his sentence for illness, which was denied by the French justice system. In October 2022, at the request of the prisoner, he was finally admitted to Martutene prison, where he has been serving his sentence ever since.
