The Provincial High Court of Gipuzkoa has ordered the Toulouse Examining Court No. 1 toreopenthe case for injuries suffered by a young man during the 2023 Toulouse Carnival .
The court in Toulouse ordered the case file in November 2024, declaring that the Ertzaintza acted "in accordance with the law and proportionally", and the judge did not consider the statement of the victim, Xuhar Pazos, necessary.
The Xuhar People's Platform, however, complained that the decision to file it was based solely on the testimony of the Ertzaintza and announced that it would file an appeal. The young man was not involved in the riots and photographs and videos have been provided showing that he was shot in the second police charge.
The incident occurred on the night of February 12, 2023, when, as a result of an altercation in a bar, the Ertzaintza intervened. Pazos, 16, was shot in the eye, resulting in a lossof vision. Since then, he has been subjected to various operations and rehabilitation processes without recovering his vision.
According to the platform, "Xuhar has not lost his eye, the Ertzaintza has prevented him" and they have stressed that they will continue the judicial process.
According toan investigation by the Ertzaintza, the projectile was directed against a person trying to throw a bottle at the agents.
According to the investigation, the projectile hit a young man's arm and bounced off Xuhar's eye, at which point he was near Xuhar. It has been ascertained that the agents complied with the protocol and that the rubber foam launches were carried out from more than 50 metres, always directed towards the lower part of the body.
