Exceeding the speed limit by more than 50 kilometres has been a crime since this Monday in the French Basque Country, and it could even lead to a prison sentence, since the French Government has decided to make this offence a criminal offence. Until now, it only became a crime when the rule was violated for the second time.
Now, however, the new provision published in the Official Journal of France last week provides that offenders may be sentenced to up to three months' imprisonment and a fine of up to EUR 3,750, which will also be recorded as a precedent.
Until now, exceeding speed limits by more than 50 kilometres per hour involved fines of up to EUR 1,500 in France, as well as the loss of six points on the driving licence, which became a crime if the same offence was committed earlier.
However, according to the Inter-Ministerial Delegation for Road Safety, this sanction mechanism was not well adapted, given the seriousness of the incidents and the increase in the number of accidents, and it has therefore been decided to tighten it up.
According to the latest data provided by Road Safety, in 2024 there were 63,217 speeds exceeding 50 kilometres per hour in France, an increase of 69% compared to 2017, resulting in 3,190 deaths in the country.
