The Supreme Court confirms the reviewable permanent prison for the accused of the Aizarnazabal crime
The Supreme Court has dismissed the appeal in cassation filed by the defence of the convicted person and found him guilty of a crime of hyper-aggravated murder.
The Supreme Court has upheld the reviewable permanent prison sentence imposed on the man convictedof the murder of DonostiarraAintzane Pujana in Aizarnazabalin January 2021.
The Criminal Division has rejected the man's appeal against the endorsement granted by the High Court of Justice of the Basque Country to the judgement of the Provincial High Court of Gipuzkoa.
"The defence's attempt to provide an alternative version of the facts is met with a large amount of incriminating material, which has been assessed by the jury and validated by the High Court of Justice upon receipt of the appeal," he has reasoned.
The man was sentenced to reviewable permanent imprisonment as the perpetrator of a crime of murder and sentenced to two years' imprisonment as the perpetrator of an induction offence to prostitution, and to four years' imprisonment for unlawful detention.
In this case, a woman, the man's partner, was found guilty of the murder, in which case she was sentenced to an incomplete exemption from mental disorder and a mitigating circumstance of confession and sentenced to 10 years' imprisonment.
