Judge Adolfo Carretero has refused to clear the case against former MP Iñigo Errejón and has summoned him on 17 February to inform him that he will open an oral trial for a sexual assault on Elisa Mouliya in October 2021.
The magistrate states in the order that "there is no reason to close the case" and clarifies that he has no official record of Elisa Mouliaa's withdrawal from the case, and therefore remains "the figure of the private prosecution".
The judge's notice that Errejón was about to start the oral trial was scheduled for last week, but the magistrate suspended it for "legal certainty" until the actor clarified whether or not he was holding proceedings against the former Summary spokesman.
In fact, a few days earlier, Mouilaa had reported through social media that he was withdrawing from the proceedings against Errejón, assuring him that, of course, that did not mean that he was retracting the charges, but that he wanted to set a "limit." He added that he made that decision because "no other victim has taken the step of reporting" and felt "alone" to "face everything."
However, as soon as it became known that the Public Prosecutor's Office had requested Errejón's acquittal in its provisional statement of conclusions, \u00A0 Mouliya explained to the media that he would continue the proceedings against the former deputy.
A day earlier, the Provincial High Court of Madrid had met to examine Errejón's request to file the case. The former Deputy had specifically requested the annulment of the decision on which he had been prosecuted in the Magistrate.
