Sentenced to 4 years and 6 months for mistreating and sexually touching a 7-year-old girl in Pamplona

The Navarra Provincial Courthas sentenced a man to four years and six months' imprisonment for sexually assaulting and touching a girl between the ages of 5 and to 7 in Pamplona.
The sentence states that the acts constitute a crime of sexual assault against a child under 13 years of age, punishable by up to four years' imprisonment; and a crime of habitual ill-treatment, punishable in this case by six months' deprivation of liberty.
Accordingto the High Court of Justice of Navarre, the man, 44 years old, will not be able to communicate or approach the victim, less than 200 metres away, for 5 years, and will have to comply with a probation measure, which will be enforced after the sentence of deprivation of liberty, for another 5 years. In addition, as civil liability, he will compensate the Navarra Agency for Autonomy and Personal Development with 2,000 euros as legal guardian of the minor.
The court decision states that the defendant had a sentimental relationship with the victim's motherof about two years before 30 March 2022.

The sentence also goes on to state that "when he was alone with the minor during the time they lived together," he touched her "constantly and with knowledge of the child's age. "
On 30 March 2022, the minor was transferred to the Observation and Reception Centre of the Government of Navarre, and on 26 September 2022 the situation of lack of protection was recognized, and on 30 April 2024 he began to live with a foster family.
The victim has low self-esteem, anxietyand inappropriate sexual developmentdue to ill-treatment.
