The officer under investigation, three families and the Santander City Council will be involved in the accident case
The judge investigating the accident has ordered new proceedings and requested protocols to respond to warnings, complaints from residents and an expert report on the status of the runway.
The presiding judge of Santander Examining Court No. 1 has agreed on further steps to clarify the collapse of the El Bocal Pass, which occurred on March 3 and in which six young people died while making a journey along the coast.
Three families of the victims, the Municipal Police under investigation and the Santander City Council (the latter as potential civil liability) have appeared in the case and have also appeared to the other relatives of the deceased and the only survivor of the accident.
Among the proceedings agreed upon, the Magistrate requests the Emergency 112 Service and the Santander Local Police to send the Protocol of Action in force on the date of the incident in response to citizens' notices, in particular with regard to the collection, classification and monitoring of incidents relating to the risks of public infrastructures, as well as any internal instruction or manual establishing criteria for action for the operators of these services.
The instructor also wishes to know whether there were any prior complaints regarding the state of maintenance and maintenance of the passage. To this end, he has requested from the Santander City Council the minutes of the North-West District Council of the last five years corresponding to the areas of Cueto and Monte. He has also ordered the Judicial Police to collect possible notices or complaints in official registers, citizen platforms, neighbourhood associations, media or social networks.
On the other hand, the judge has appointed a judicial expert, an engineer in Roads, Canals and Ports, to inspect the passage and issue a report on whether there were obvious signs of deterioration, when the last maintenance work was carried out and whether the maintenance work was sufficient or negligent. The report must also contain the regulations in force at the time of the construction of the infrastructure, as well as the current inspection and maintenance requirements and the periodicity of the reviews.
According to the Scientific Police Inspection Act , the structure's brackets and screws were severely degraded by corrosion and completely oxidized areas.
