The judge has shelved the case of Amaya Zabarte for failing to verify the origin of the impact
The head of Examining Court No. 4 of Donostia-San Sebastián, Ana Isabel Pérez Asenjo, has ordered the filing ofthe case Amaya Zabarte, who was injured on March 5, 2024, before a Champions League match in Anoeta.
The resolution is based on the statements of the Ertzaintza, which concludes that it has not been established that the blow to the head was caused by a foam ball, as reported to the private prosecution representing the Novoa family.
The family hasuntil this Wednesday to lodge an appeal, which shall be decided by the judge himself, and if rejected, they may appeal to the Provincial High Court, for which a further period of five days shall be opened.
The decision has caused "utter disappointment" to the family, although they have acknowledged that they were not surprised. They recall that the case was filed at an initial stage, a few days after the complaint was filed.
