Noelia, a 25-year-old from Barcelona, will receive euthanasia today after justice has guaranteed her right to a dignified death, despite her father's opposition.
The European Court of Human Rights has refused to suspend the proceedings on a precautionary basis, following an unsuccessful appeal by the father in all Spanish judicial instances. The request for urgent measures was rejected by the Strasbourg Court, but the application is still pending and could be considered later.
The judicial case began after the authorization of euthanasia in Catalonia in July 2024, when the father appealed the decision of the Committee on Guarantees and Evaluation. A court cautiously suspended the practice, but then dismissed the appeal on the grounds that the young man, who was of age, had full decision-making power.
The High Court of Justice of Catalonia, the Supreme Court and the Constitutional Court have upheld this conclusion because of the lack of capacity of the applicant and the absence of irregularities in the proceedings. The courts have declared that Noelia's decision has been final and conscious since the beginning of the proceedings.
In the television interview, the young man defends his position and declares that he wants to "go in peace and stop suffering, "while acknowledging his family's disagreement. His father, represented by the Christian Lawyers Association, declares that the legal requirements are not met and argues that there are psychiatric records.
