The Supreme Court has placed the AttorneyGeneral of the State, Alvaro García Ortiz , on the verge of trial after confirming hisprosecution for alleged disclosure of secrets in the case of Isabel Diaz, boyfriend of the President of Madrid, Ayuso.
The Appeals Chamber of the Supreme Court has rejected in a decision the appeals of the Public Prosecutor's Office and Alvaro García Ortiz against the decision of the investigating judge of the Supreme Court, Angel Hurtado, to prosecute the Attorney-General.
The Appeals Chamber of the Supreme Court has taken a majority decision on García Ortiz, supported by two of his three judges, Julián Sánchez Melgar and Eduardo de Porres.
The third judge, Andrés Palomo del Arco, has issued an individual opinion on the grounds that the case against the Attorney-General should have been dismissed because he had not provided any previously unknown information on the case of González Amador.
The Chamber considers that the evidence gathered in the investigation is sufficient to enable the prosecution against García Ortiz for the facts under investigation to proceed.
Pilar Rodriguez Fernnandez , on the other hand, has shelved the investigation against the chief prosecutor of Madrid for lack of evidence of a crime.
The decision of the Chamber states that "there is no question that the Attorney-General's Office legitimately intends to challenge information it did not consider appropriate" in the case against Alberto González Amador, the boyfriend of Isabel Díaz Ayuso, but understands that "in order to respond, it was not necessary to disclose confidential information".
He adds that "while it is true that there were leaks prior to the proceedings against Gonzalez Amador" and that "these leaks also provoked complaints from the Attorney General of Madrid, these leaks are unrelated to the subject matter of this investigation".
On the other hand, he warns that the "disappearance of information from mobile phones and postcards" by García Ortiz "was intended to conceal it in the face of a possible investigation." The decision of the Chamber reproduces the facts and arguments put forward by instructor Angel Hurtado.
