The Public Prosecutor's Office has requested the opening of proceedings against the President of Acciona for not attending the Navarre Commission of Inquiry
The Navarre Parliament has twice summoned businessman José Manuel Entrecanales and has missed the appointment on both occasions. According to the Public Prosecutor's Office, disobedience could be considered a crime.
The Navarra Public Prosecutor's Office has requested the investigating court to initiate proceedings against the President of Acciona, José Manuel Entrecanales, for failingto appear before the Committee of Inquiry into the Public Awards of the Navarre Parliament, despite having called him twice in January and February. The Public Prosecutor's Office considers that the facts could constitute a crime of disobedience and requests that Entrecanales be summoned to testify as an investigator.
The President of Acciona has been summoned twice to that Committee of the Navarre Parliament, on 20 January and 9 February.
In connection with the works carried out or financed by the Governmentof Navarre during the four Azk legislatures, Acciona participated in . The purpose of the commission was to know the knowledge that Entrecanales has of the tendering, award and administrative procedures in which he participated.
In place of the President, Acciona sent to Parliament two representatives of the company: Joaquín Mollinedo, Director of Institutional Relations, Communication and Brand, and José Julio Figueroa, Member of the Board of Directors, but they were not allowed to take the floor before the Commission because they had no summons, and the company also submitted a letter arguing that "the summons is addressed to the Company, not to the President on its own behalf", and that the call "violated the right of the Company to appoint its representative".
However, the Public Prosecutor's Office considers that the absence of José Manuel Entrecanales "is unjustified" since "the Parliament itself expressly warned" that his statement of allegations and the presence of the two directors sent by the company "could not replace his personal appearance".
The Public Prosecutor's Office considers that the facts may constitute an offence against State institutions provided for in article 502 of the Criminal Code and therefore requests the Court to initiate criminal proceedings.
