In a statement, the ELA union has stated that the Supreme Court's admission of the appeal against collective dismissal shows that the merger with the failed Jesuitinas school and the dismissal of the workers was a "dark and poorly managed" process that caused "the concern of the families and the diversion of enrolment of the students" until, in the end, "the final closure of the school"; "all with the approval and complicity of the Basque Government", according to the union.
The High Court of Justice of the Basque Country (TSJPV) has proved the ELA union right and has declared null and void the collective dismissal of 59 workerspromoted by the Bidaide Foundation, to which the JM College in Bilbao belonged. According to ELA, the ruling shows that the process of evictingthese 59 people has been "dark, bad faith and unnegotiated."

In this regard, he points out that the attempt to merge with the Jesuitinas Collegewas "obscure and poorly managed" , an attempt was made to "hide" the existence of the business group in the process and caused "the concern of the families and the diversion of enrolment of the students, ultimately condemning the school to its final closure".
All this, according to the plant, was done "with the approval and complicity of the Basque Government".
ELA has explained that the TSJPV ruling states that there was a group of companies for work purposes and concludes that "the Bidaide Foundation and the two congregations that own the buildings of two of the schools that made it up (the JM Congregation and the Congregation of the Sisters of Charity) are part of the same structure ", thus establishing solidarity responsibility for all of them.
According to the union, "one of the reasons the dismissal has been declared null and void is that they have tried to conceal reality by preventing real negotiation."
The other reason has been that the purpose of the negotiation process should have been "to negotiate opportunities to avoid redundancies"; but, referring to what was stated in the ruling, ELA explains that "the decision to close the school was prior to the start of the negotiation period to avoid redundancies".
