A man has been sentenced to 11 years in prison in Zizur Mayor for leaving his victim paraplegic in an attempted murder
The accused, a native of Pamplona and diagnosed with a mental disorder, must compensate the victim with EUR 3 million. Since the date of the incident, he has been in pre-trial detention and will no longer be able to communicate with the injured person or approach him less than 200 metres for 20 years.
The First Section of the Navarre Court has sentenced a 52-year-old man to 11 years' imprisonment for shooting five times at an acquaintance on 20 March 2024 in Zizur Mayor and in the middle of the street, who was paraplegic as a result of a bullet that hit his back.
The judgement states that the defendant, a neighbour of Pamplona, must compensate the victim with EUR 3 million for the very serious consequences caused.
The court considers him to be the perpetrator of an attempted murder offence, mitigating mental anomaly.
He has been in pre-trial detention since the date of the incident and will nolonger be able to communicate with the injured person or approach him less than 200 metres for 20 years, and will also remain in custody after his release for another 10 years.
At the trial on 17 December, the prosecution requested 15 years' imprisonment and the private prosecution 25 years, while the defence requested acquittal on the grounds that there was a complete exemption for delusional psychotic disorder linked to toxic consumption.
On 20 March 2024, the victim went to Zizur Mayor, Santa Cruz de Ardoi Street, where the defendant lived, and they both knew each other and had a prior appointment.
The sentence proves that the defendant went down to the street and went straight against the accuser, who, when he stood beside him "with a clear intention of killing," shot him twice in the right leg.
The victim, who was bleeding heavily, fled. The attacker continued to run and, in the race, shot him three times. He was shot two times, one in the abdomen and the other in the back.
According to the court decision, if the accused did not die, it was because of matters not in the possession of the assailant, namely the rapid intervention of the police and medical services, and the immediate health care given to the injured person. "
"If urgent medical assistance had not been provided, the patient would have suffered a life-threatening situation, "he adds. The injured person has a recognized disability level of 75% .
The defendant is diagnosed witha dual disorder , a mixed personality disorder (disocial and paranoid) linked to the consumption of alcohol, cannabis and stimulants, substances which at the time of the incident were under the influence of the court, but the court considers that expert evidence does not guarantee that the defendant, at the time of the attack, had nullified his intellectual and voluntary faculties.
