The court has upheld the absolute disability due to occupational illness of a BBVA worker and confirmed the occupational origin of cancer after decades of exposure to asbestos in Tower 1 of Gran Vía, while other reports indicate that there are more cases linked to the same building.
Social CourtNo. 5 of Bilbao has dismissed the appeal filed by BBVA against the decision of the National Institute of Social Security (INSS) declaring absolute incapacity arising from occupational illness due to exposure to asbestos.
The worker, who worked in the building for more than three decades , performed administrative duties between 1960 and 1999, was diagnosed in April 2023 with sarcomatoid pleural mesothelioma and died of this disease on 24 July 2025.
The ruling confirms the professional origin of the pathology and rejects the BBVA thesis. Bankua argued that exposure to asbestos could also occur in other work activities.
The court found that the disease was not compatible with any professional activity.
According to an Osalan report cited in the procedure, at least six bank employees and three other external maintenance companies developed asbestos-related pathologies in that building.
The Basque Association of Asbestos Victims, Asviamie, stresses that the sentence reinforces the link between the worker's illness and this material in the structure of the building and recalls that asbestos was used in much of the facility.
